A misdemeanor conviction can result in up to one year in county jail and fines—often up to $500, although some offenses carry higher penalties. It may also create a public criminal record that affects employment, housing, professional licensing, driving privileges, and firearm rights in certain cases.
Felony convictions carry far more serious consequences, including state-prison sentences of more than one year, life imprisonment, or—in capital cases—the death penalty. Repeat felony convictions can lead to enhanced sentencing. A felony may also limit voting rights while a sentence is being completed, prevent jury service, result in permanent firearm-rights restrictions, restrict professional licensing opportunities, make housing and employment more difficult, and create immigration consequences for non-U.S. citizens.
In a criminal case, you are presumed innocent unless the prosecution proves every element of the charge beyond a reasonable doubt. This generally means proving both that you committed the alleged act and that you had the required intent. A strong defense examines police reports, witness statements, and other evidence for inconsistencies or weaknesses that may create reasonable doubt.
Oklahoma criminal offenses generally fall into two categories: misdemeanors and felonies. Misdemeanors are less serious offenses, such as some first-time DUIs, simple assault, or petty theft, but can still carry jail time, fines, and a criminal record. Felonies are more serious charges punishable by state-prison time or, in limited cases, death, and may include drug trafficking, aggravated assault, burglary, and homicide.
